Terms of Service

Last updated: November 2026

These Terms of Service (the "Terms") govern your access to and use of the Policy Tools platform, websites and related services (collectively, the "Service") provided by Policy Tools LLC ("Policy Tools", "we", "us" or "our"). By creating an account, accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Who may use the Service

The Service is designed for insurance professionals, including licensed agents, agencies and their authorized staff in the United States. By using the Service you represent that you are at least 18 years old, that you have the authority to bind yourself or the organization you represent, and that any insurance-related activity you perform through the Service complies with the licenses and regulations that apply to you.

2. The Service

Policy Tools is an operating platform for insurance businesses. Depending on your plan, the Service may include client management (CRM), quoting and enrollment workflows, a resource center, training content (Academy), scripts, operations tools and integrations with third-party services such as HealthSherpa, marketplace platforms, carrier portals and rating engines.

Policy Tools is a software provider. We are not an insurance carrier, broker, agency of record or producer, and we do not provide insurance, legal, tax or compliance advice. You are solely responsible for the products you sell, the quotes you present and your compliance with applicable insurance laws and carrier requirements.

3. Accounts and security

  • You must provide accurate and complete information when creating an account and keep it up to date.
  • You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
  • You must notify us promptly of any unauthorized use of your account.
  • We may suspend or terminate accounts that violate these Terms or that create risk for other users or for the Service.

4. Plans, pricing and payment

The initial version of the Service is free. Paid features follow a usage-based model: your costs grow only as your business grows, based on the plan and usage you select. Current pricing is shown inside the platform or provided to you when you upgrade.

  • Paid subscriptions are billed in advance on the billing cycle you select and renew automatically unless cancelled.
  • You may cancel at any time; cancellation takes effect at the end of the current billing period.
  • Fees are non-refundable except where required by law.
  • We may change pricing with reasonable advance notice; changes apply to the next billing period.

5. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of insurance, marketing, telemarketing (including TCPA), privacy or consumer protection laws.
  • Upload or process data you have no right to use, or misrepresent your identity, licenses or affiliations.
  • Interfere with the Service, probe its vulnerabilities, or attempt to access accounts or data that are not yours.
  • Resell, sublicense or provide the Service to third parties except as expressly permitted by your plan.
  • Use the Service to send unsolicited or deceptive communications to consumers.

6. Your data

You retain all rights to the data you and your clients submit to the Service ("Customer Data"). You grant us a limited license to host, process and display Customer Data solely to provide and improve the Service. Our collection and use of information is described in our Privacy Policy, which forms part of these Terms.

You are responsible for having the consents and legal basis required to submit your clients' information to the Service, including any consents required for communications with consumers.

7. Third-party integrations

The Service may connect to third-party platforms (for example HealthSherpa, marketplace systems, carrier portals or rating engines). Those services are governed by their own terms and policies. We are not responsible for the availability, accuracy or conduct of third-party services, and your use of them through the Service is at your own risk.

8. Intellectual property

The Service, including its software, design, branding, training content, scripts and documentation, is owned by Policy Tools LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes while your account is active. You may not copy, modify, reverse engineer or create derivative works of the Service except as permitted by law.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR THAT QUOTES, RATES OR DATA OBTAINED THROUGH INTEGRATIONS WILL BE ACCURATE OR CURRENT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLICY TOOLS LLC AND ITS OFFICERS, EMPLOYEES AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE OR LOST DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED US DOLLARS (US $100) IF YOU PAID NOTHING.

11. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Upon termination, your right to use the Service ends; we may retain or delete Customer Data as described in our Privacy Policy.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email before they take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. Any dispute arising out of these Terms or the Service will be resolved in the state or federal courts located in Florida, and you consent to their jurisdiction.
